Now filling out the I-130 & in Section
C, question 21 has us baffled. It
says to check one & complete:
_ Your relative
will apply for a visa abroad at
the American Consulate in________________________.
_ Your relative
is in the US & will apply for AOS
to that of lawful permanent resident
in the office of the INS at______________.
If your relative
is not eligible for AOS, he or she
will appply for a Visa abroad at
the American Consulate in _______________.
Well, since
Guy is here in the states with me,
we're assuming we check the second
choice & state Portland, Oregon.
Do we also complete the second part
of that answer? And if so, how do
we know which Consulate? He's Canadian
& from Toronto. Does that statement
mean "if he can't stay & is deported"
then he goes to the American Consulate
in Toronto? Or is that just for
spouses who are not in the US? Thanks
for any help, tho it appears many
here think we are in deep doo-doo
do to the way we got married.
I guess all
we can do is tell the truth, cuz
we really didn't intend on getting
married, we were just going to travel
& when we got to Vegas we got all
misty-eyed (since we had met there
originally our first time real time)
and we just decided "Let's do it".
Has ANYone reading these boards
gotten married this way & been successful
at getting to stay? The Portland
INS office was really nice to us,
didn't sound like they thought he
was going to get deported. ::sigh::
It's so wonderful to be together,
but everyday there's a glimmer of
hope, then we read some bad news
too. (Also having problems with
my Alzheimer's affected Mom, but
that's best left for another newsgroup.....)

Well, since Guy is here in the
states with me, we're assuming we

Do we

that answer? You don't .. you
can put N/A for Not Applicable there
because it asks where he will apply
if NOT eligible. As the spouse of
a US Citizen he is eligible and
will be applying for the AOS in
Portland, Oregon as you answered
in the first part of question.

It says: ' If your relative is *not*
eligible ' ......but you *are* eligible,
so although I haven't been through
this process, I wouldn't complete
that bit! It is my understanding
that he can only stay here 3 months,
that is the way the ppl from other
countries like UK, Germany, etc...
The interview must be done in the
home country too..
