Question:
I'm a green card holder and currently applying a green card for my wife who
is living /w me in the states.
Recently I make address change and when i get the address change
comfirmation from the NVC (national visa center), they stated that my wife
need to process her application at an american consule at my home country.
But when I first apply, i already stated on the application that she
currently reside in US. Does she really have process her application out of
the country? What should I do?
Answer:
Does she have a visa that allows her to stay in the US? If not, she must wait
outside of the US until her immigrant visa becomes current.
she have H1 visa right now, should i contact NVC to have her application
process in the country rather that out of the country? and her priority date
is current at this point.
If she has an H1B, there is no need to leave the US until the spousal visa is
processed/current. I am not sure what NVC meant, does she just have to pick up
her greencard stamp in another country? Maybe somebody else can clarify this.
First of all what is the status of your wife? There are different rules
that apply to Citizens as to Green Card holders (permanent residents)...you
may need a lawyer. How did your wife enter, on what status? Need more
info.
yes, she has H1B, That's what i'm not sure of weather if she need to process
her green card in another country, because the letter from NVC (National
Visa Center) mention that her process information will be send to american
consuler at my home country..
My wife have H1B visa and i'm permanent resident.
