It is NOT a loophole. Abuse does happen. Claiming abuse is not an
automatic
fasttrack to a green card.
That kinda requires that you had a spouse that was a USC or LPR, that
they battered you and that you can show some evidence that this is true.
The Catholic Charity portion is irrelevent really.
Yes, it is my sister applied for it and used it and she got her green card .
she was not abused but it did work try it and her the link

It isn't up to Catholic Charities to check. It has to be PROVEN to INS.
If it was that easy, there would be many more people getting them.

People lik you and your sister could be the cause that REAL abused women
might not get in because of law changes....
I do not have much respect for those who mess with the law like this.
My guess is that he is the one that was accused.
This is not fair for those who are abused. People who abuse these programs
take up time and funding that could be spent helping someone who's life
could depend on it. It is also unfair for the rest of us who did things
honestly and the hard way. The reason the INS has made the process
difficult is to weed out people who are not sincere about being a true and
real American who upholds the law. After 9-11 you think people would have
more respect for the law.
i agree with you. im going thru hard times right now filling this form and that
one and oops i forgot to dot this I or cross this T. but i would do it all
again just to make sure i did things correctly and according to the law. No way
do i want my husband to come here then find out because something was done
wrong he has to leave.... by the book is best...
Consider this.. A name that is unfamiliar to the group all of a sudden
starts posting about using "abuse" to get a green card. I tend to think
that he is not here to brag about his sister, but to complain about an
actual case he was involved in. Or, perhaps just a troll..
As I understand it.. The abuse must be proven in order to become a PR.
In any case, the original poster of the other thread (replied to by this
same person) was asking about conditions being removed. In that case, an
abuse claim isn't needed and the suggestion of such was NOT appropriate,
especially since the OP of that topic didn't mention any abuse.
It's also not fair to the person who's been wrongly accused of abuse.
All it'd take is one really driven social worker to press things and
some poor guy could be charged (and possibly even convicted) of abuse
and have to carry that around for the rest of his life.
And then there's the emotional abuse of finding out the person you
married only married you so they could accuse you of a crime to get a
green card.
Or, perchance it is as Michael suggested, a disguised post from a guy
accused of abuse....this will remain so shrouded in mystery that we
will never know sufficent facts to make an informed decision or
recomendation.
The guy just can't deal with how he got to where he is...hence this
sillyness.
Anything that doesn't happen and use that to get a green card is a "FRAUD".

to set the record straight: No, we certainly don't "train" anyone.
We, as well as the INS, need strong evidence of physical or emotional
abuse. We look hard at the evidence. If we come to the conclusion
it's fraudulent, we immediately cease representation.
Self-petitioning for battered spouses is an important remedy provided
by Congress for those who qualify. The last thing any of us wants is
for people to abuse this possibility.
