Question:
Okay here is my problem... I hope my idea is right. I sent our file out
for removal of conditions in november... her green card exp. is feb 2
2007 now i look online and see that the fee is now 275 dollars and I
may have filed the wrong form. it is of course christmas now.. will I
get a letter back saying i filled wrong? and if i do can i correct it
like it says or refile. I seen that they cashed my check already
through my bank.. but If i refile in the middle of january... and her
card exp in feb will that be enough time? I know it says with 90 days
but how close are you allowed to be. I would send another one out but
dont know how that would affect it.. or if its an older form with they
just deny it or will they send for the rest of what they need?
Answer:
Get an Info Pass appointment it will put your mind at rest but remember
to document everything they tell you, keep the info pass and get the
Officers name CYA.
I would not send another one and waste more money until you know if you
did send the wrong one? what makes you think that you did?
And if you do have too then the time frame Jan is fine.
The increase in fee is relatively new. The reports are that the $205 is
acceptable and all should be fine. There is absolutely no need to
refile an I-751 for your wife.
If they want the $70 biometric fee, they will contact her via snail
mail. Has she received her Notice of Action yet showing receipt and
extending her green card for one additional year?
No I havent yet I saw that they cashed the check on nov 27 and some say
4 weeks to get your noa and its exactly 4 weeks tomorrow but there is
holidays in there...cause it just has to be filed by the exp right?
which is feb 7 i think
Yes, the filing has to be done before the expiration date on the green
card. The proof of mailing and receipt of it having been received will
serve as proof of such and that with a copy of the petition and evidence
filed with the petition should allow your wife to obtain an I-551 in her
passport if the Notice of Action is never received. Believe it or not,
that is not unheard of. Also on the back of your cancelled check should
be a case under, that ~might~ aid in the proof of filing if needed.
Hoefully this will ease your mind: my wife just filed her I-751 with the
$205 fee and mailed it on December 1 and it was officially received on
December 5. She got a proper notice of receipt and the biometrics
appointment shortly thereafter. In other words, all is well with her
application and we won't have to pay the new fee.
We're feeling kind of lucky since it appears that we just made the
deadline for using the old fee.
okay then which office did you send it to... Ours went to Nebraska in
November and havent got anything yet.
What service center did you file through?? We filed November 27th and
still don't have a receipt or notice of biometric appointment yet.
Vermont (VSC) November 28th it arrived there and our check was
cashed the 29th
It was the California Service Center. YMWV :P
