Question:
I recently sent in my I-751 to remove the conditions on my green card.
We got it in (and the return receipt sent back to us so I know they got
it) about a week before my green card expired on the 7th of November. I
just wanted to make sure that it's ok that I haven't got my extension
letter yet while they process my application? They said I had to get it
in before the 2 year anniversay. Am I still ok and should I still get
my extension letter even though my green card has expired? I'm
travelling out of the country in December so I'm just a wee bit
concerned.
Answer:
The card is automatically extended until the I-751 is adjudicated,
assuming it was properly filed. All you know so far is that the I-751
was delivered. You don't know that it was accepted. Was your check
cashed, meaning that they have accepted your I-751 for processing? Most
people receive the NOA extending the I-551 in 1-3 weeks from submission.
You like to leave things to the last minute, eh? You can send the I-751
in up to 90 days before the I-551 expires.
Btw, if for some reason they reject it and need more info or something
(dont think they will but kind of panicking) and I have to send it back
to them will that be a problem because my green card has now expired?
