I am about to fill out the application for the Green CArd lottery. If my wife is a US citizen, do I need to include her info in the application?

if your wife is a US citizen you can get a GC thru marriage ..why use the lottery

You must mention your wife. The instructions require it. It's best to be fanatically literal when following instructions. Don't second guess anything.

Are you from one of the qualifying countries Evo? Remember as well that they don't start processing until Oct 2004 so if your main prority is to be with your wife in the US it may not be the quickest way to go.

Lottery will be a faster way to go. Thru, marriage it will take muich longer. 1-2 year for interview, then wait another 2 yrs to remove the conditional green card. so total takes 4+ yrs to get a GC. Once you hit the lottery, u will get a permanent GC. no waiting. less headache. Agree?

Huh? Even the conditional one is a GC. There is no difference, except for the condition that you have to stay married. It may also be possible to use CP or DCF, which are much faster.

People who are selected for DV2005 can only apply for a GC during fiscal year 2005, i.e., from Oct. 1, 2004 to Sept. 30, 2005. It has happened in the past that legacy INS or USCIS took over a year to process the I-485, with the end result of the person not getting the GC. And of course, it is a _lottery_. There is no guarantee that you even are selected. On the other hand, getting the GC through marriage is a sure thing (as long as the marriage was entered in good faith.)

Additionally, AOS based on DV is time-limited/sensitive - you must be done during that fiscal year.

Consider that a. nothing guarantees you a low case number in DV and b. USCIS has been known to take its sweet time processing those AOS. Then it would be smart to consider consular processing, which meens travelling out of country. Now this might get complicated, especially if you need to return to US without IV - you can not be issued a non- immigrant visa because of your marriage to a USC. (You'd be best advised not to travel out of country at all ).

Also, if you get LPR status after being married for 2 years, the status is unconditional.

It seems to me from reading this and your previous postings that you have a different agenda than most..it look like you just want that greencard any old way...and if you can get it by a marriage of convenience or Diversity lottery you will go that way... Sorry EVO you are a sham

Do you happen to know what the procedure is the following case ?

My girlfriend won a GC in a lottery. We were about to get marry but you know we never could make up our minds , I was in the middle of writing my thesis at the university so we were kinda going to marry but not at that point. Once she won the thing she got crazy and wants to move to states now (she said she got 1 year or something from the date of notification) . My question is : If we get marry after she won GC will it be ok for me to go with her as well ? We have been together for the past 4 years so splitting would sux. Can somebody please give me links to what shall be done in such case – I assume she needs to claim me somehow.

If you want to immigrate with her and have a green card, you must marry her before her interview at the consulate. Once married, tell it to the consulate. And then, you can show up at the interview with her (it would be safe to bring proof that you already were together for 4 years). If you marry her after her interview, you won't be able to have a green card anytime soon.

Plus the fact that it on average takes freaking long if she claims me as a spouse. We have none such evidence as mentioned above. My friend told me that it is far faster to marry an USC than if a fresh GC, not even processed thoroughly fails for his spouse. Marrying the USC is not an option for me and I heard that the procedure with GC claiming his/her family takes 5-6 years ...so now I think I have a task to convince my girl friend to stop thinking about immingration or ...break the relationship .. which would sux..... Is it the case ?

Marcin, it's true that "the procedure with GC claiming his/her family takes 5-6 years ..." -- that's what I meant by "If you marry her after her interview, you won't be able to have a green card anytime soon."

But if you marry before the interview, there is a chance that you can both get green cards at the same time. When you say you have "none such evidence," could it be true that there is no person among the friends and family of either of you, or your professional associates from your jobs, that has known that "you are a couple" for a period of time, like a year? It seems odd, as if you are unnaturally isolated.
