Question:
I just received my green card interview notice from INS.
I am H4. My husband (H1-B) is the primary petitioner.
The notice tells me to bring the following to the interview:
passport, official ID, medical exam results,
originals of all documents submitted with my application,
current letter of employment, W-2 and income tax forms
for the last three years,
marriage certificate, insurance policies,
rental agreements, deeds, bank/credit statements,
utility bills, wedding photos
and any other evidence to show marriage is bona fide.
It also says that the interview will be video taped.
Could anyone tell me what questions will be possibly
asked at the interview?
Is it necessary to bring an attorney with me to the
interview?
Answer:
I am assuming that your husband applied under an employment-based
category? In that case, interviews are rather unusual. They can
indicate one of two things. INS selects about 3% of all cases at
random for an interview. They also pull any case that seems
suspicious, which is another 2% or so. 95% are never asked for an
interview.
So your case may have been pulled at random, or there may be something
unusual. Try to figure out what that might be. This is what the
interview will most likely focus on.
If you were pulled at random, the interview could be about almost
anything.
By the way, was your husband interviewed? If not, he should already
have his approval. If he doesn't, you won't get your GC at the
interview, but rather the case will be continued until he gets his
approval.
Maybe INS simply doubts the legitimacy of the marriage (the list of
documents you gave seems to suggest something like that, or it could
just be a form letter). This could happen for instance if the marriage
is very recent.
I would be kind of surprised if that was indeed the case because this
type of interview would usually be for both of you
It depends on the circumstances and why you were asked for the
interview. It may well be worth at least discussing the situation with
an attorney, just to see whether you were indeed pulled at random. As
far as I know, the attorney will not be permitted to be in the room
with you for the interview, but he could wait for you outside and
assist from there if necessary.
An H-1 can petition for a Green Card for an H-4?
Amazing!
Can a F-1 petition for a Green Card for a B-2?
Can a L-1 petition for a citizenship for a J-1?
I guess what she meant was that her husband's employer had sponsored a GC for him and his family.
