Question:
I'm working in Company A right now , but I'm going to file a H1B
transfer to company B recently . I have two questiones need your help .
First can I apply for Green Card in Company A during my H1B transfer ?
Second , company B is in CA ,because there will be a long delay for H1B
transfer , maybe i have only 4 years and 4 months to apply for Green
Card after the new H1 get approved , is the time enough for Green Card ?
Answer:
Company A can apply for green card on your behalf, but if you change to
B you will have to start the GC process again, with B.
It could be enough, or it could not. no one knows how the situation will
be in 4 years. It also depends on how big the backlogs of your country
are (especially if you are from India or from China)
Only if you will go back to company A. You can only get a Green Card
if you plan to work for the employer who sponsored you AFTER you get
your GC.
Impossible to predict, but chances are, yes. By the way, B can get the
Green Card process started right now. They don't have to wait until
you have your H-1B.
When you get a sponsored GC you have to work for the company that sponsored
it. How long for, when can you leave the sponsoring company? if atall.
Depends. General wisdom is that two years after getting your GC is
clearly safe, and if you have already worked as an H-1B for that
employer for a long time, you may quit much earlier than that. Some
attorneys say, as early as one months after getting the GC.
Of course, the longer the better.
