Question:
i have applied for the green card a while back (1 year since start). as
of today she has siad she is waiting for congress to meet to offer more
green cards at the end of the month, and hopefully the next step will go
ahead then. problem is my H1B expires in a few months, and now she is
saying i will need to renew it. so i have a few queations:
1. do i actually need to renew it or is there something easier and
CHEAPER that i can get to authorize work while waiting for the green
card?
2. how easy is it to renew a H1b, is it something i can do? she
charges 1000.00 so if i DO need to renew it can i do it myself and
save money? i thought i read that the renewal is the same as the
initial application with a couple minor changes. i didnt do the
inital app, but since i paid for it i am sure i can get a copy (or
something)
2. are there any other options i have???
Answer:
anyone? is this post in the right place???
Has she had you on her couch yet?
Yah... get a new lawyer! The employer must file for an LCA and submit
an I-129 petition. If the petition is approved, you can apply for the
H-1B visa.
my employer has to do that even if it isa renewal of a HB1?? i am here
on one now, and is it easy enough to do, that i could do it?? any help
is appreciated!
Only an employer can file an LCA and petition for an H-1B, and the
employer must pay most of the application fees (not including
attorney costs if an attorney is used).
i understand that an employer needs to do that for a inital application
(which they did), but what about a renewal, i was told by my employer
that they would not pay for a renewal and that i had too.
also is the renewal paperwork the same as the inital application??? if
so, and i do have to do it myself - maybe i could just copy the first
one and change whatt needs changing.
There is very little difference between an initial application and
a renewal. More or less the same requirements apply.
One difference is that anyone already on an H1B is not subject to the H1B
quota when renewing.
so as far as the steps to do this go, i just have fill out a I129 form,
and send it in with the fee? if i am wrong what are the steps that i
need to take? thanks in advance!
"as of today she has siad she is waiting for congress to meet to offer

green cards at the end of the month " ?????
Never heard of such a thing. Looks like she is taking you for a ride.
As for H1B renewal, since you seem to be not familiar with the process,
hire another lawyer. A good one. Don't try to do it yourself at least
this time.
Or if you want consultation on the process try www.murthy.com.
They offer over the phone consultatation for a samll fee. I used them
two years back when I had some questions and needed professional
advise.
and that is what she said - she is waiting for more green cards to be
released by congress, and she also said there are 40 others applicants
at her office in the same situation.
i have been trying to read as much as possible about the process and i
have another I128 form for a renewal thatis complete to help go by. also
i know that the employer needs to file the LCA which i also have a copy
of one of those too. it seems you file the LCA then file the I129, and
both paperwork seems pretty straight forward. i am just unsure about who
fills it all out etc. i plan on contacting my central office soon to see
what they do. but i like to have my plan in order before i start (if i
do) so any help at all would be great!
