Question:
Is it possible to apply for green card simultaneously through
marriage and employment?
I read two contradictory statements and got confused. One was saying
that I can apply simultaneously and will get the green card through
whichever gets approved first. The other statement was that the
second application will cancel the first one.
I am currently working with my OPT and also waiting for my H1B. My
employer can sponsor me for a green card later. I also have a US
citizen girlfriend and we plan to marry soon. What would be best for
me to do? Apply for Green Card through marriage, employment, or both?
Would the application affect my H1B status?
Answer:
If you plan on getting married soon, go the marriage route. It will take you
2-3 years in the best case scenario to get an employment based green card .
If your marriage is genuine, that's the way to go, I think. Yeah, your green
card will be conditional for the first a couple of years, but if you plan on
being married for the rest of your life, there is nothing to worry (and it
will be cheaper).
You can do both
Doesn't the second application cancel the first one?
No.
Keep in mind that you can file just one Adjustment of Status application
(I-485) though! Either based on the I-140 (employment based immigrant
petition) or the I-130 (family based immigrant petition).
An alternative would be to do AOS on one and consular processing on the
other.
Great idea! Never thought of that!
