I need some advice on my situation.
I entered the US on a K1 visa in January. I married my USC husband in
late January and had our baby in March. I applied for AOS at the end
of March, as well as for advance parole. Both are pending.
As I was stuck in bed for the last couple months of my pregnancy, I
didn't apply for a SSN or change my driver's license (from Canada). My
I-94 expired at the end of March, and my AOS is pending.
Here's my question.
What is my eligibility for a SSN without an EAD? I didn't apply for an
EAD because I'm staying home with the baby for now. But without a SSN,
I can't get a driver's license or a joint bank acct with my husband. I
worry how this will look at the AOS interview?
Answer:
You needn't worry how this will look at your AOS interview -- that's
probably about a year away.
You won't be able to get a SSN until you
get your EAD card. That being the case, you'll want to fill out and
send in an I-765 so you can get your EAD card. I know this process is
tough, but unfortunately that's the way it is for everyone.
There are
some banks (mostly big national ones) that will give you an account
without a SSN.

V - my husband got his social security # BEFORE he got his EAD and
BEFORE we got married - he got the ss# waaaaay before the EAD.
He
applied for the ss# about 3 days after he entered the country and he
got it in the mail about 2 weeks later. We didn't apply for AP & EAD
until about 1 month later - both came 3 months later.
So what I'm
saying is - I'm not sure if it's the case that you *can't* get a SS#
w/out the EAD. We went down the office with his

email/directive/notice fr the INS stating that & how people entering on
K1 fiancee visas are eligible for a ss#
and that's it, if my memory
serves. It came in the mail not to long after. I think you should
revisit the situation again. Doesn't hurt to go down there and apply
for one - if they say no - then no harm, no fowl - you're just back
where you started.
(btw - are you refering to entering on a fiancee
visa)
On the drivers lic end, it's true - at least it is/was here in
NYC. He couldn't get a drivers lic/state id, etc until he got his EAD.
Bank wise - he was able to open an account quickly because he got his
ss# quickly but our bank was willing to let him get on my acct to be
joint without one.

SSN Application for an Alien Whose Status Is About to Expire
An SSN application should not be processed for an alien whose status has
expired, or will expire within 14 days of the date the SS-5 would be
triggered. This is to prevent an alien's receipt of the SSN card after
his/her status has expired.
An alien whose current status is about to expire but who has applied to INS
for an extension/change in status should be told to return to SSA when
he/she has the extended/new documents.
Do not process the alien's SSN application if an INS response to a G-845,
Document Verification Request, verifying the alien's status is received
within 14 days of the date the alien's documents will expire. Rather,
inform the alien that SSA cannot process the application because the
alien's status will expire before the SSN card would be received. Tell the
alien that he/she can return to SSA if INS extends his/her status or grants
a change of status. You can use an SSA-L676 for this purpose.
So head on down to your local SSA office and get your SSA-L676.
You should have applied for EAD with AOS application. With A# (Alien
registration number) on EAD, you can apply for SSN. You should apply
for EAD asap.

added my husband (who entered as a fiance on a K-1) to my existing
account, and opened a separate new account in his name, and added me to
it....without his SSN.

In other words, you COULD HAVE gotten an SNN up to 14 before your K-1 visa
expires -- which is 90 days from when you enter the US. But now that your
K-1 has expired, you have to wait until you get an EAD to get an SSN.
Bank of America. They opened an account for me without an SSN, and they're a
great bank to be with. No problems whatsoever as long as I've been
there. :)
