Will they make him wait to be fingerprinted and then let him come back to get the stamp

Question:
My fiance recently came into the US and entered at Chicago OHare. He was not fingerprinted. I am wondering if he will have a problem when we AOS in Detroit next month? Since the stamp is supposed to be issued that day, will they make him wait to be fingerprinted and then let him come back to get the stamp?

Answer:
K-1s are not fingerprinted. (That was already done) Also they do not fingerprint people at the airport unless they do something bad. About what stamp are you speaking? I am going to make some assumptions since you left out some important details. He is your fiance. Therefore he entered as a K-1 on a K-1 Visa? Fiance(e) Visa holders do not get any kind of stamp per se. There used to be the Employment Authorized stamp, but if you are AOS'ing in Detroit, no need to fool with EAD stamps. AOS is a one day affair in Detroit for K-1's. If he just entered on a tourist visa, you can't go to AOS next month, only K-1's do it in a day. You'll have to file an I-130 for your relative in the US.

No biggie, but different set of forms and filing rules. You'll have to let us know which you are doing, K-1 or I-130. If a K-1, then no stamps needed, just go to the AOS and be very happy you live in the Detroit jurisdiction.
