I needed clarification on 3 questions for Immigration Application:

1. As per the new rules, is it necessary to apply from the applicant's own country of residence?. Can one apply with one year of work experience from Buffalo, NY? In that case any specific difficulties.

I understand that, it is the responsibility of the applicant to get the VISA & attend the interview /medical test if s(he) applies from USA.

2. Is it necessary to take the English language Test if the applicant is from India?

3. When are these new rules coming into into effect? What is the significance of new rules for the applicants after March 31st'2003? Any benefits for applicants if applied before March 31'2003 in particular?

1. Regulations state the following:

------------------------------------------------------------ 11. (1) An application for a permanent resident visa - other than an application for a permanent resident visa made under Part 8 (refugees) - must be made to the immigration office that serves:

(a) the country where the applicant is residing, if the applicant has been lawfully admitted to that country for a period of at least one year; or

(b) the applicant's country of nationality or, if the applicant is stateless, their country of habitual residence other than a country in which they are residing without having been lawfully admitted. ---------------------------------------------------------------

2. Yes.

3. New rules came into effect on June 28th, 2002 and apply in full (with pass mark of 75 points) to all applications received after December 31, 2001.

Only applications received before that date are being processed under old law until March 31st 2003 - after that deadline such cases will be assessed under new law with transitional pass mark of 70 points.

So, March 31, 2003 is irrelevant for you if you are to apply now.
